Pension benefit restrictions – do they apply to your plan?

The funded status of many pension plans plummeted during the last quarter of 2008 as we experienced unprecedented financial market volatility and dramatic value decreases including complete collapses of some investments. While the funding level at the end of a plan year affects the amount the plan sponsor must contribute it can also cause a plan to become subject to benefit restrictions and/or a complete benefit freezing. Many plans will see these new rules for the first time in 2009, and depending on a plan’s exact funding level, restrictions could be applicable 1 April 2009.
